Design Ownership & Project Terms
Custom Part projects. Nathan Gardner, doing business as Eternal Artisan Keepsakes, retains ownership of the original designs and electronic production files he creates. Customers receive the physical items listed in their quote and may use them for their intended personal or business purpose. Design fees do not purchase ownership, exclusivity, production files, or permission to manufacture copies. Nathan may reproduce, adapt, manufacture, license, and sell his retained designs. Lawful resale of a purchased physical item is not prohibited.
Commercial Ownership projects. Ownership is available only through a separately priced, signed project agreement. The agreement identifies the final design and deliverables, assigns the specified transferable intellectual property rights to the customer after full payment, and defines the customer's rights to manufacture, modify, and sell the design. It also sets out Nathan's obligation not to reproduce, resell, license, or adapt the assigned design without the customer's written permission. Any interim prototype or review use is specified separately.
Files and excluded material. Commercial quotes must list the file formats and editable source files to be delivered. Nathan's pre-existing libraries, tools, methods, and unrelated designs are not automatically transferred. Any retained material embedded in the final design must be identified and licensed sufficiently to allow the agreed commercial use. Customer-owned and third-party material must be disclosed, with required permissions or assignments resolved before incorporation. Print-only customer files remain customer-owned.
Confidentiality and portfolio use. Confidentiality requirements must be agreed before materials are shared. Customer names, protected branding, and confidential information will not be published without permission. Commercial Ownership designs will not be used in Nathan's portfolio without the customer's written permission.
Your signed agreement controls. The selected quote option is an inquiry, not an automatic transfer of rights. Scope, price, payment, revisions, deliverables, ownership, and any exclusions must be agreed in writing before work begins. A transfer conveys only rights that exist and can legally be transferred; it does not establish patent protection or guarantee that a design is free of third-party rights.
